Gag Clause Clears Senate

The Senate voted to pass S6940.  The Assembly passes same as bill A8781 earlier this season.  The next stop is the Governor's desk for signature.

Talk about a Catch-22

Gag Clause
Pharmacists across the country have contracts with Pharmacy Benefit Managers (PBM's). Many of those contracts prohibit pharmacists from telling their customers whether it's cheaper for them to pay for a drug through their insurance or out-of-pocket (Gag Clause). A clause from the provider manual of one PBM states "minimum penalties of $5,000 per incident per day."
